Lanham Act Patent Defense
Successfully defended a Lanham Act case in which my client was accused of false representation for claiming ownership in a portfolio of patents by a former joint venture partner who misappropriated the portfolio patents for its own account; the settlement entailed assigning the patents in exchange for a stream of royalty payments.
Medical Imaging Patent Defense
Successfully defended a value added reseller who was accused of infringing five patents on medical imaging software; won on eleven summary judgment motions; Non-Infringement and Invalidity Rulings were all Affirmed by the U.S. Court of Appeals for the Federal Circuit in one word: Affirmed.
CMYK Printer Patent Success
Successfully obtained more than a dozen patents on modifying a CMYK toner printer to printing with a white toner cartridge or other specialty toner cartridges, such as clear or sublimation toner, including patenting single pass over printing, single pass under printing, and patenting a printer that can easily switch between both over printing and under printing.
Healthcare IP Defense Settlement
Successfully defended a healthcare products manufacturer against claims of patent infringement and trademark infringement; settled the case by exchanging our client's domain name for money.
Flame Retardant Patent Defense
Successfully defended a patent infringement case brought against our British client by a U.S. company over flame retardant materials; settled by purchasing the patent for less than the costs of procuring it.
Trademark Rejection Overturn
Successfully overturned a preliminary decision by the USPTO to deny two trademarks to an established Household Appliance/Electronic Wholesaler. Crafting a persuasive response to the Office Actions issued by the USPTO, HPL.LAW overcame both initial rejections and the trademarks became registered.
