Trademarks

Successfully overturned a preliminary decision by the USPTO to deny two trademarks to an established Household Appliance/Electronic Wholesaler. Crafting a persuasive response to the Office Actions issued by the USPTO, HPL.LAW overcame both initial rejections and the trademarks became registered.

Corporate

Conducted IP due diligence on numerous asset sales and sales of businesses, for both the buyer and the seller (not on the same deal) to determine whether the Intellectual Property involved is titled in the name of the correct entity and, when necessary, fixed the title and ensured that the IP rights were current and enforceable (or, in at least one case, advised the prospective buyer to drop the deal, because the IP was essentially worthless).

Represent a nationally-famous motorcycle racer in a trademark and domain name dispute with his former business partner/brother.

Copyrights

Advised numerous clients on how to negotiate with Copyright Trolls to lower the amount of blood money that was being demanded for essentially innocent use of photographic images for which no license had been obtained in advance by the clients.

Negotiated a multi-country license for trademark rights and franchises; termination clauses were so favorable to our client that when the licensee breached, it ended up purchasing our client-licensor.

Successfully defended a Lanham Act case in which my client was accused of false representation for claiming ownership in a portfolio of patents by a former joint venture partner who misappropriated the portfolio patents for its own account; the settlement entailed assigning the patents in exchange for a stream of royalty payments.
